Ilya Prokopets

Ilya Prokopets joined Rosenberg & Estis, P.C. in 2015 as an associate with the firm's Litigation Department. Mr. Prokopets' practice involves complex commercial and residential landlord-tenant litigation. Mr. Prokopets has extensive experience representing both residential and commercial landlords and tenants in a variety of disputes. Notable Work • Successfully obtained emergency injunctive relief in favor of a Brooklyn-based client against a national retailer illegally operating in the client's commercial space. • Successfully defended a non-payment proceeding on behalf of residential cooperative shareholders by invoking Multiple Dwelling Law § 302, which proscribes a landlord from collecting rent where the building's certificate of occupancy does not comply with the actual use. • Negotiated a settlement consisting of nearly $300,000 in arrears and attorneys' fees in favor of the client-owner after obtaining a judgment of possession and money judgment against a net lessee. • After trial, was instrumental in successfully obtaining a judgment of possession in favor of a SoHo landlord against a tenant claiming an illusory tenancy defense. • Represents a multinational hotel chain in its defense of, inter alia, a breach of lease claim asserted by a former tenant and fast food franchisee. • Represents a Times Square landlord in a market-rate rent reset arbitration. Mr. Prokopets received a bachelor's degree in Housing and Community Development from Arizona State University and earned his juris doctorate from New York Law School, where he was awarded the Professor James Kibbey Memorial Award for his excellence in commercial law. Mr. Prokopets is licensed to practice law in New York. Prior to joining Rosenberg & Estis, Mr. Prokopets served as an Associate Attorney with Shiboleth LLP. Earlier, Mr. Prokopets was a Legal Extern with Karp & Kalamotousakis LLP and a Legal Intern with Thor Equities LLC. Prior to that, Mr. Prokopets was a Summer Associate with the New York City Law Department.
