About Majed Dakak

Majed Dakak is a seasoned trial attorney and Partner at Kesselman Brantly Stockinger LLP, where he represents clients in complex business litigation, antitrust and non-compete disputes, high-stakes class actions, employment and whistleblower matters, and professional liability cases. With a background spanning an elite antitrust law firm, Big Four consulting at Deloitte, and SEC-related investigations, Mr. Dakak offers clients a rare blend of courtroom advocacy and strategic financial insight. He brings deep experience handling high-stakes litigation—including representing and litigating against Fortune 500 companies—and consistently delivers results in complex legal and regulatory settings. Representative Cases

  • Lead counsel in a statewide class action against a national freight company challenging unlawful non-compete and non-solicitation clauses under California Business & Professions Code §16600 and §16600.1.
  • Defending a New Jersey-based food distributor in a federal unfair competition and tortious interference lawsuit involving exclusive distribution rights to a specialty tea brand.
  • Representing the seller of a business in defeating a non-compete enforcement claim in arbitration and obtaining a final arbitration award on a breach of contract counterclaim, including damages, interest, attorneys’ fees, and costs. The arbitration award was confirmed as a court judgment.
  • Defending a property owner in a federal fair housing and disability access lawsuit alleging architectural and communication barriers at a 47-unit apartment complex.
  • Represented a commercial borrower in a consolidated bench trial over DSCR-based loan default and foreclosure claims, obtaining a favorable trial ruling on all liability issues.
  • Representing a food service company and its owner against a former accounting firm for breach of contract, fraud, and professional negligence related to excessive and unauthorized billing
  • Represented a former Army colonel in a successful Ninth Circuit appeal defeating a motion to dismiss under the Feres doctrine. The court held that her sexual assault claims against a retired four-star general and the United States could proceed, establishing that they were not barred as incident to military service.
  • Represented a California-based manufacturing company in confirming a $3.27 million arbitration award arising from a dispute over the breakup and asset division of a former joint venture. Successfully defeated a petition to vacate the award, with the court affirming the arbitrators’ authority and awarding post-award, pre-judgment interest.
  • Represented a construction company and its principal in a post-judgment motion to vacate a $1.6 million default judgment, including $1 million in punitive damages.
  • Represented a class of healthcare workers in a certified wage-and-hour and PAGA action involving paid sick leave and nondiscretionary pay violations. Secured final court approval of a $4.75 million settlement against a major California hospital system.
  • Represents a public healthcare district concerning healthcare competition issues and other healthcare related matters.
  • Represents a homeowners association that sued a developer for breach of contract and breach of fiduciary duty.
  • Represented a plaintiff in a matter dealing with a nonprofit corporation’s breach of charitable trust and breach of contract.
  • Represented a putative class of real estate agents against a nationwide real estate company for failure to properly classify its employees. That matter received final approval in favor of the for $4.5 million.
  • Represented plaintiffs in a derivative action brought by shareholders of a two corporations against a corporate officer who breached her fiduciary duty.
  • Represented a physician and health care entities in an antitrust group boycott trial against a major hospital.
  • Represented plaintiffs in a class action against AT&T for exploiting its customers by grossly overcharging, in relation to its cost, for non-published and non-listed telephone services.
  • Represented victims of an international hijacking in a matter dealing with international law, statutory interpretation, professional malpractice, and complex contractual liability.
  • Represented an investment firm in a breach of contract and fraud action arising out of the sale of an MRI patent portfolio.
