Mark D. Shields

Mark D. Shields specializes in the representation of businesses in commercial litigation including general liability, construction and real property disputes, professional liability and employment related matters including wage and hour claims, ADA compliance, unfair competition, class actions and misappropriation of trade secrets. Mr. Shields is also experienced in transactional matters and corporate formation. Mr. Shields attended the University of Northern Iowa where he received bachelors degrees in Criminology and Spanish. He earned his J.D. at California Western School of Law in 2001 after transferring from the University of Miami School of Law. While in law school, Mr. Shields volunteered as a law clerk for Catholic Charities Legal Services and was the recipient of a National Public Interest Law Grant. Mr. Shields also worked as a law clerk at a firm specializing in insurance bad faith and catastrophic personal injury cases. Mr. Shields is admitted to practice before all California and Arizona state courts and the United States District Court, Southern and Eastern Districts of California. Representative Matters Litigation • A high-six-figure settlement was obtained for client, the victim of trade secret misappropriation involving a multi-sport race event. • Dismissal was obtained of the complaint after the court granted motion for summary judgment in a subrogation action filed by insurer, in which the insured general contractor was not properly licensed at time of construction of the project. • Recovered 100% of funds loaned by client on a promissory note (plus attorneys' fees and costs) to a real estate investor after investor refused to pay back the promissory note. • Judgment was obtained as to plaintiff's complaint against a fitness club in a slip-and-fall case, based on a liability waiver set forth in membership agreement.
