About Robert L. Rediger

Robert L. Rediger is a founding partner of Rediger Labor Law, a law firm that limits its practice to the representation of employers in labor, employment, and class action defense. Mr. Rediger received his B.A. cum laude from Queens College, and his J.D. from Hofstra University School of Law, where he concentrated his studies in labor law and litigation. For several years, Mr. Rediger taught classes on Labor Law and Employment Law at the University of Northern California School of Law. He speaks regularly at seminars and writes articles on personnel-related issues. He is a member of the Labor and Employment Law Sections of the State Bar of California, and of the American, Sacramento, and New York State Bar Associations. He is an active member of the Rotary Club of Sacramento. Traditional Labor Law Mr. Rediger regularly counsels employers on countering union organizing campaigns and through NLRB election proceedings. He has defended employers accused of committing unfair labor practices in trials before the NLRB and on review of NLRB decisions in the federal courts of appeal, and has defended employers in federal court in suits brought by union-affiliated Taft-Hartley trust funds. He has negotiated numerous collective bargaining agreements with various labor unions throughout the United States, including multi-employer CBAs in Los Angeles, San Francisco, San Jose and Sacramento. He has represented employers in labor arbitrations on numerous and varied procedural and substantive issues under CBAs he negotiated. Employment Law Mr. Rediger regularly counsels employers on preventative policies, procedures and other measures to take to avoid employment-related litigation. He has defended employers before administrative agencies, judicial arbitrators, and in federal and state courts in such matters as wage and hour class actions, discrimination, harassment and retaliation, wrongful termination, unfair competition, PAGA, trade secrets, workplace violence injunctions, etc. In 2015, Mr. Rediger was lead counsel in EEOC v. Placer ARC where a unanimous jury in federal court returned a verdict in favor of the employer, rejecting claims of disability discrimination prosecuted by the EEOC under the ADA. Class Action Defense Mr. Rediger defends employers in class action lawsuits alleging violations of the wage and hour laws, including under the UCL and PAGA. In 2012, Mr. Rediger argued the case of Kirby v. Immoos Fire Protection, Inc. in the California Supreme Court which resulted in a decision holding that neither an employee nor an employer may recover attorney's fees as a "prevailing party" in an action alleging missed meal and rest periods. Mr. Rediger has litigated numerous cases in federal and state courts across the country, several of which have resulted in precedent setting decisions favorable to employers, and several of which have been the subject of news articles: "When the EEOC Gets It Wrong" (U.S.E.E.O.C. v. Placer ARC, 2015 WL 9653976 (E.D. Cal. 2015)). "Ruling: Winners in Meal Break Cases Can't Collect Legal Fees" (Kirby v. Immoos Fire Protection, Inc. (2012) 53 Cal.4th 1244).
