Wynne P. Kelly

Biography Wynne P. Kelly has an extensive litigation and judicial background in both the public and private sectors. Wynne has worked in large law firms in New York, New York, and Miami, Florida, defending large companies in high stakes litigation. Wynne also served in the Department of Justice for over 16 years, first as a civil assistant United States attorney for the District of Columbia representing the United States government in federal court. Wynne has federal jury and bench trial experience, has argued before the U.S. Court of Appeals for the D.C. Circuit numerous times, and has taken and defended dozens of depositions. Wynne remained in the Department of Justice after receiving an appointment by the Attorney General to become an immigration judge. Wynne developed a reputation for his preparedness and fairness in adjudicating the cases before him, resulting in his promotion to Assistant Chief Immigration Judge and, subsequently, to Principal Counsel for Conduct and Professionalism in the Office of the Director. Finally, Wynne was named Senior Counsel to the Associate Attorney General. Judicial Experience Wynne began his judicial career in February 2019 when he was appointed as an Immigration Judge at the Arlington, Virginia Immigration Court, while also serving details to the New York, New York Immigration Court and the Houston, Texas, Immigration Court. Wynne heard both detained and non-detained matters and developed a reputation for his preparation and inquisitive nature on the bench, but also his common-sense approach to adjudication. From January 2023 until January 2025, Wynne served as an Assistant Chief Immigration Judge overseeing the Sterling, Virginia Immigration Court. In this role, he managed court operations, supervised administrative functions, and presided over complex immigration proceedings including deportation, exclusion, removal, and rescission hearings. Because of Wynne’s skills as an adjudicator and a manager, leadership selected him to serve as a mentor to numerous immigration judges and attorney advisors, as well as to lead trainings for new immigration judges and advanced trainings for experienced adjudicators. Senior Leadership From January 2025 through May 2025, Wynne served as Senior Counsel to the Associate Attorney General working within the Sanctuary Cities Enforcement Working Group, a top priority of the Attorney General, analyzing the intersections of federal immigration law and various state laws and policies. Prior to joining the Office of the Associate Attorney General, from June 2024 through January 2025, Wynne served as Principal Counsel for Conduct and Professionalism in the Office of the Director for EOIR, a Senior Leader (SL) appointment by the Attorney General. In this role, Wynne led a team of attorneys processing, investigating, and analyzing all complaints brought against immigration adjudicators nationwide. Wynne established new standard operating procedures including standardization of the initial triage of all allegations received, as well as designed supplemental training regimens when complaints identified correctable deficiencies. Wynne led numerous internal investigations and coordinated with various components of the Department of Justice depending upon the outcome of those investigations. Wynne also supervised the operations of the Equal Employment Opportunity office and worked closely with the Office of General Counsel and the Justice Management Division on numerous matters. Finally, Wynne served as an expert witness on federal immigration processes and procedures in federal court proceedings in the matter of Securities and Exchange Commission v. Mikhail Kokorich, No. 1:21-cv-01869 (D.D.C.). Other Public Service Prior to his judicial appointment, Wynne served as an Assistant United States Attorney for the District of Columbia in the Civil Division from November 2008 through February 2019. Wynne represented the United States in hundreds of civil proceedings before federal district courts and U.S. courts of appeal. He led numerous parallel civil investigations of companies for alleged waste, fraud, and abuse, primarily under the False Claims Act, and secured millions of dollars in settlements, fines, and penalties, for U.S. taxpayers. Further, Wynne served as lead counsel on numerous jury and bench trials, took and defended dozens of depositions, and submitted hundreds of dispositive pleadings. Wynne’s achievements earned widespread recognition including: the Attorney General’s Award for Distinguished Service; U.S. Attorney Special Achievement Awards (7); as well as commendations from, for example, the Judge Advocate General for the U.S. Army, the Acting Director for the Bureau of Alcohol, Tobacco, Firearms, and Explosives, and the Department of Transportation. Education and Professional Development Wynne holds a Juris Doctor from the Fordham University School of Law, where he served as the Editor-in-Chief for the Fordham International Law Journal and an Associate Editor of the Fordham Moot Court Board. Wynne obtained a Bachelor of Arts with a double major in Government and English from Georgetown University. Professional Memberships and Community Involvement Wynne was admitted to the New Jersey Bar in 2006, the New York Bar in 2006, the Florida Bar in 2007, and the U.S. Supreme Court Bar in 2015. Wynne co-founded the Dave Nee Foundation, a 501(c)(3) not-for-profit corporation dedicated to raising awareness of depression and preventing suicide in the legal and law student community.
