Angela E. Pozzo

MEDICAL & HEALTH CARE LITIGATION Angela Pozzo is an associate in the Medical and Health Care Litigation group of Moser & Marsalek, P.C. She joined the firm in 2004. She focuses her practice on defending physicians, nurses, long term care facilities and other health care providers in medical negligence, ordinary negligence and wrongful death litigation. Ms. Pozzo also has experience defending medical device manufacturers. Over the past five years, Ms. Pozzo has defended physicians, nurses, health care institutions, long term care facilities, and medical device manufacturers in all aspects of litigation, including second-chairing multiple medical negligence and wrongful death trials. In 2006, she tried her first medical negligence case and obtained a defense verdict for a local oncology practice against a claimed failure to timely diagnose lung cancer. In 2001, Ms. Pozzo obtained a Bachelor's degree, summa cum laude, from Illinois State University with a double major in political science and communications. She received her law degree from Saint Louis University School of Law in 2004, along with Certificate in Health Law Studies. During law school, Ms. Pozzo completed an internship with the U.S. Attorney's office for the Southern District of Illinois where she presented to a state task force on nursing home fraud and abuse. SELECTED CASES Trinidy Noldon, by and through her next friend and mother, Vatisha Chester v. Saint Louis University, St. Louis City Circuit Court, Missouri, 2008. Ms. Pozzo served as second chair counsel with Principal Phillip Willman in the successful defense of Saint Louis University in obstetrical negligence case that claimed the fourth largest defense verdict in Missouri in 2008 by Missouri Lawyer's Weekly. Connie Parish v. Bond, M.D., and Kingshighway/New Halls Ferry Medical Services, LLC, St. Louis City Circuit Court, Missouri, 2008. Ms. Pozzo served as second chair counsel with Principal Philip Willman in obtaining a unanimous defense verdict in favor of a local internist. Plaintiff alleged the defendant internist failed to appropriately manage her blood pressure causing her to suffer an intracerebral hemorrhage resulting in brain injury and left-sided neurologic deficits. Hoff v. St. John's Mercy Medical Center, et al., St. Louis County Circuit Court, Missouri, 2007. Ms. Pozzo served as second chair counsel with Principal Philip Willman in obtaining a defense verdict for a local spine surgeon. Plaintiff, a trauma patient with a thoracic spine fracture and a seizure disorder, alleged a spine surgeon delayed surgery, resulting in his experiencing seizures and paralysis. Marla Cohen v. Ballas Cancer Center, d/b/a St. Louis Cancer and Breast Institute, L.L.C., et al., St. Louis County Circuit Court, Missouri, 2006. Ms. Pozzo successfully defended St. Louis Cancer and Breast Institute against Plaintiff's claim that her lung cancer was not timely diagnosed. PUBLICATIONS Medlaw Update, DRI Newsletter case note, April 2009, reporting on the Missouri Supreme Court's holding in Janice Sides v. St. Anthony's Medical Center, et al., 258 S.W.3d 811, (Mo. banc 2008), that in a medical negligence case, plaintiff may proceed under a theory of res ipsa loquitur by offering testimony of medical experts that the injury would not have occurred in the absence of defendant's negligence.
