Gabrielle Pretto

Gabrielle Pretto is an associate at Lax & Neville LLP and has experience in a variety of commercial litigations and arbitrations regarding securities and investment disputes, employment matters and regulatory investigations. Since joining Lax & Neville LLP, Gabrielle represented several individuals and entities in customer sales practice disputes against their broker or broker dealer involving fraud, selling away, churning and breach of fiduciary duty, and has also handled investment banking and hedge fund commercial litigation matters. Additionally, Gabrielle represents financial services professionals in a myriad of employment matters including compensation disputes, transitions, promissory note negotiations, Form U-5 negotiations and expungement matters. She has effectively defended numerous industry professionals in regulatory defense matters, including investigations commenced by the Financial Industry Regulatory Authority, Inc. A substantial portion of Gabrielle's practice involves representation of defendants in bankruptcy adversary clawback proceedings, including filing claims with the Securities Investor Protection Corporation on behalf of victims, defending federal and state clawback fraudulent conveyance claims and preferential transfer claims, and successfully negotiating settlements and/or the approval of hardship applications. Notably, Gabrielle represents victims of the notorious Bernard L. Madoff Securities, LLC Ponzi scheme and the multi-million dollar Agape World, Inc. Ponzi scheme. Gabrielle has participated in litigation in State and Federal Court, including Bankruptcy Court, has participated in appeals before the New York Court of Appeals for the Second Circuit and the New York State Appellate Division, and has extensively arbitrated cases before the Financial Industry Regulatory Authority and the American Arbitration Association. Gabrielle was an Article and Notes Editor for the American Bankruptcy Institute Law Review and a student and legal intern at the St. John's University Securities Arbitration Clinic. Additionally, Gabrielle has interned for the U.S. Commodity Futures Trading Commission and the Department of Justice - Asset Forfeiture and Money Laundering Sector.
