John Jacks represents individuals and businesses in a variety of areas, including breach of contracts, property owner associations, commercial disputes between competitors, protection of trade secrets, construction litigation, collections and partnership and shareholder disputes. John also represents individuals and businesses in disputes arising under the Texas Deceptive Trade Practices Act. John has more than 20 years of experience litigating cases in state and federal courts at both the trial court and appellate levels. Background: Upon completing law school, John served an Assistant Attorney General for the State of Texas where he gained significant experience representing the State of Texas in habeas corpus proceedings at all levels of the federal court system and was recognized by his peers for outstanding appellate advocacy. In 1997, John left government service and joined Walker, Bright & Whittenton where he primarily practiced personal injury defense. In 1999, John joined Gray & Becker as an associate and became a partner in 2005. Representative Experience: Represented creditor in commercial litigation case arising out of the fraudulent conveyance of assets and obtained judgment in favor of creditor in excess of $200,000 plus pre-judgment interest and attorney fees. Represented web-based business in multijurisdictional litigation arising out of alleged tortious interference with exclusive personal services contract. Successfully defended Fortune 500 Company in a variety of personal injury claims in state and federal court. Represented partnership in complex commercial litigation arising out of alleged breach of an interest rate swap agreement as part of commercial loan. Represented national financial services company arising out of alleged breach of loan servicing agreement resulting in favorable settlement. Represented seller of component parts of computer seeking to enforce a covenant-not-to-compete and confidentiality agreement, which resulted in a permanent injunction in favor of client. Represented individuals against a national seller of credit card and check collection services on claims arising under the Texas Deceptive Trade Practices Act, resulting in favorable settlement on behalf of clients. Represented individual against local ice vending business on claim of nuisance, resulting in jury verdict and judgment in favor of client who was awarded a permanent injunction as-well-as damages. Represented computer technology support company on computer hacking claim by former employee. After initial denials of involvement by former employee, successfully proved former employee’s involvement, which resulted in a judgment imposing a permanent injunction and awarding damages.
