Charles K. Gould

Charlie is an experienced trial attorney who for the past 18 years has devoted his practice exclusively to defense litigation in both state and federal courts throughout West Virginia and southeast Ohio. Charlie’s extensive defense practice ranges from complex commercial and consumer litigation to serious injury/wrongful death cases. He also has briefed and argued matters before the Supreme Court of Appeals of West Virginia, Ohio Courts of Appeals, and the United States Court of Appeals for the Fourth Circuit. Charlie’s recent trial experience includes: • Defense of engineering firm in a professional negligence claim involving a multi-million dollar waste water system upgrade project (Defense Verdict- State Court) • Defense of a municipality and police officer in a Section 1983 wrongful death claim (Defense Verdict – Federal Court) • Defense of an employer in wrongful termination/employment discrimination matter (Defense Verdict – State Court) • Defense of professional negligence and engineering design claims related to a waste water system upgrade (Favorably resolved during trial) • Defense of breach of contract, misrepresentation, and fraud claims against property owners arising from sale of property (Defense Verdict – State Court) • Defense of property owners in challenge of a restrictive covenant by property developer (Defense Verdict in Bench Trial – State Court) • Successfully prosecuted contribution claim of automobile dealership against manufacturer in subrogation action (State Court) • Defense of criminal charges against teenager alleged to have failed to comply with lawful orders of police officer (Acquittal – State Court) • Defense of employer in a deliberate intent action. (Resolved favorably during first day of trial – State Court) In addition to his wide-ranging trial experience, Charlie has skillfully resolved countless cases through dispositive motion briefing, mediation, arbitration, and direct settlement negotiation.
