About Brian M Culnan
Brian is Of Counsel at O'Connell & Aronowitz, practicing in the Health Law, Labor and Employment, and Litigation departments. With nearly 30 years of experience in complex civil litigation, he represents a diverse range of clients, including healthcare providers, not-for-profit organizations, physician practices, executives, and manufacturers, in both state and federal courts, as well as before administrative agencies. Brian advises on a variety of employment-related matters, including discrimination, termination, restrictive covenants, trade secrets, whistleblower claims, and ERISA issues, and also conducts reviews of corporate policies to ensure compliance with labor laws. In healthcare, Brian handles cases related to hospital credentialing, managed care liability, Medicaid reimbursement, and investigations into professional misconduct. He represents clients in proceedings involving HIPAA, EMTALA, Stark Law, and ADA violations, as well as governmental investigations and compliance with healthcare worker mandates. Additionally, he provides guidance on confidentiality issues for alcohol and mental health treatment facilities. Prior to joining the firm, Brian was a partner at Iseman Cunningham Riester & Hyde, Rivkin Radler, and Barclay Damon. Active in his community, Brian is involved with Christian Brothers Academy and has a long history with the Adirondack Board 36 of the International Association of Approved Basketball Officials.
