Despite being a “no fault” state, an injured worker can often feel that they are suddenly the enemy. Receiving multiple phone calls from different people working under the umbrella of the Bureau of Workers’ Compensation can be confusing. Statements can be taken out of context and even be used against you in the processing of your claim. Injured workers simply want to get fixed and get back to work as quickly as possible. Todd’s goal is to assist in that process against a system that often feels like it just doesn’t care. Born and raised in Ohio, Todd has three adult children. Proud of them all, two have gone on to be lawyers helping injured people in other states. He enjoys reading, traveling and golfing as time permits. When asked what has changed in the last thirty years, Todd responds: A lot! Most people that come to see me simply want their life back. In a fraction of a second their life has changed. They have gone from being a provider for themselves and their family, to being injured and in pain. They want to be fixed and get back to work ASAP! It is difficult to be patient during this process. If you have been injured at work, your remedy is an Ohio workers’ compensation claim. In most circumstances, the employer is given immunity from negligence. You cannot directly sue them. Workplace injuries must be reported through the Ohio workers’ compensation system. To report a work-related injury through your private insurance can, in some circumstances, be interpreted as insurance fraud. A workers’ compensation claim can take time, especially if you don’t know where to begin. Sometimes employers can be helpful in steering you in the right direction, but often the injured worker is left to figure out the system by themself. Most employers have professional representation, you should too! The system can feel informal but be careful. You can now phone in or appear through the internet for hearings before the Industrial Commission of Ohio. The hearing officers are making decisions about your life, your medical treatment, and your compensation. Why wouldn’t you want to be there in person? It is always the injured workers’ responsibility to prove that the injury happened at work and that the physician’s diagnoses are related to your injury. The fact that it happened at work is sometimes not enough. The hearing officers are looking for specific evidence in precise legal language. If you don’t have it, that can mean the difference between winning and losing your claim. You cannot assume that anybody at the hearing is on your side. The workers’ compensation system is often adversarial. Representing injured workers is what I have devoted my career to over the last 30 years. I want to help injured workers not only understand the system but also get the treatment and compensation they deserve. It is sometimes harder than people realize and there are organizations working against the injured workers’ goal to get better and back to work.
